These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Truevyn ("Truevyn," "we," "us," or "our"), a company organized under the laws of Oregon, governing your access to and use of the Truevyn platform, website, payment processing, market intelligence reports, and all related services, features, and content (collectively, the "Service").
You must be at least 18 years of age to use the Service or make a purchase. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms and any purchase agreement.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date or by sending notice to your registered email address. Your continued use of the Service after such modifications constitutes your acceptance of the modified Terms.
Truevyn provides custom market intelligence reports for used vehicles. Our Service analyzes data from local peer-to-peer and dealership listings to deliver hyperlocal vehicle valuation reports based on the vehicle specifications and geographic location you provide.

Custom market intelligence reports are currently priced at $29.00 per report. This is a one-time payment for each individual vehicle report requested.

We do not store your complete credit card information on our servers. All payment card data is transmitted directly to and stored by Stripe in compliance with PCI DSS standards.

The Service, including but not limited to all software, algorithms, data collection methods, data processing techniques, analytical models, databases, proprietary methodologies, reports, templates, source code, user interfaces, designs, graphics, text, images, and all other content and materials (collectively, "Truevyn IP"), is owned exclusively by Truevyn and is protected by United States and international intellectual property laws.

If you provide us with suggestions, ideas, feedback, or other information regarding the Service, you assign to Truevyn all rights, title, and interest in such feedback. Truevyn may use, disclose, and exploit such feedback without any obligation to you.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct and the accuracy of information you provide.

You acknowledge that these limitations of liability are essential elements of the agreement between you and Truevyn, and that we would not provide the Service at the current price without these limitations.
You agree to indemnify, defend, and hold harmless Truevyn, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:
Before initiating arbitration, you agree to first contact us at truevyn@truevyn.com to attempt to resolve the dispute informally. Provide a detailed description of the dispute and your desired resolution. If a dispute is not resolved within sixty (60) days after submission, either party may initiate arbitration.
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in Portland, Oregon, or via videoconference or telephone if mutually agreed.
For claims under $10,000, Truevyn will pay all AAA filing, administration, and arbitrator fees. For claims over $10,000, fees will be allocated according to AAA rules.

You have the right to opt out of this arbitration agreement by sending written notice to truevyn@truevyn.com within thirty (30) days of your first purchase or acceptance of these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.
These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions.
For any disputes not subject to arbitration, you agree that such disputes shall be brought exclusively in the state or federal courts located in Multnomah County, Oregon, and you consent to personal jurisdiction in these courts.
These Terms remain in effect for as long as you access or use the Service or retain any purchased reports.
You may stop using the Service at any time. However, purchases already completed are final and reports already delivered remain subject to these Terms.
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Truevyn concerning the Service and supersede all prior agreements.

You consent to receive communications from us electronically via email. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, internet outages, or failures of third-party services.
